Books for Mediators

A very good book for beginning and seasoned mediators alike, this book closely  follows the "phase model" of facilitative mediation used at CMC.

The narrative mediation approach encourages the conflicting parties to tell their personal "story" of the conflict and reach resolution through a profound understanding of the context of their individual stories.

This book examines the personal qualities that make a mediator effective. Each contributor demonstrates that at the very heart of conflict resolution is the subtle interaction between the parties and the mediator's personal and authentic style.

The long-awaited second edition of a classic by Folger and Bush, this book describes the transformative mediation model, and includes a transcript of the role-play called "The Purple House".

Takes us into challenging and potentially transforming territory by shedding light on how too narrow a commitment to neutrality or an exclusive focus on ‘resolving’ disputes can limit our usefulness in the clashes of passion, positions, and power struggles inherent in how people actually confront (and avoid) their deepest conflicts.

Practitioners need to be comfortable with a wide variety of tools to diagnose different problems, in vastly different circumstances, with different people, and resolve these conflicts effectively. This book gives you all the tools you need: eight different models for dealing with the many conflict situations you encounter in your practice.

This is a first-rate work on both the 'why' and the 'how' of mediation. It is meaty, written in a refreshingly readable style, and is deserving of a very wide audience of professionals and interested members of the public.

Subtitled "Multi-party Mediation in a Complex World."  Says Kofi A. Annan, UN Secretary General,
"An invaluable resource for anyone seeking to grasp what makes for successful mediation and conflict management in an increasingly unmanageable world. . . . It will fascinate as well as educate the reader whether student or practitioner."

This workbook offers you exercises and scripts you can use to practice these skills and make them your own. The workbook extends the techniques of Messages to a wide range of situations.

One of the best books using neuro-linguistic programming (NLP) techniques.

This book by the author of Beyond Neutrality explores the place where conflict resolution and the work we do in it isn't just about a profession and a business, but the meanings and values that are at the heart of it.

Basic Skills for the New Arbitrator provides a detailed overview of arbitration, from the prehearing phase through the hearing and deliberation of the award. It guides the new arbitrator through the arbitration process by answering the one hundred questions most frequently asked by new arbitrators.

One of the best "non-mediation" books on reading body language.  Written by the Dog Whisperer, Cesar Milan, who says that dogs are not only man's best friends, they also read human body language better than any other species.  A wonderful gift for the dog-lover too!

Augsberger writes of the many different ways that cultures interact with each other, and how cultures approach conflict. There are many ways to approach conflict: different approaches to gender conflict, different beliefs on the nature of shame and "saving face", different ideas on what is effective resolution- and all are equally valid, with both good and evil in the different cultures, and the different methods.

Consensus is fast becoming one of business' most popular-but most widely mis-understood decision-making models. By involving people in the decisions that impact their work, companies develop a passionate team of workers, one that is committed to a future they’ve helped shape. This useful guide leads managers, consultants, and facilitators through the consensus-building process. It shows how to avoid common pitfalls like false agreement and the “illusion of inclusion.”

Subtitled "A Blackfoot Framework For Decision-Making And Mediation Processes", its narrow focus on two health structures on the Peigan reserve - one based on Blackfoot culture, the other on Western European health theories.

The authors, associated with Harvard Law School and the Harvard Project on Negotiation, show how such dialogues actually comprise three separate components: the "what happened" conversation (verbalizing what we believe really was said and done), the "feelings" conversation (communicating and acknowledging each party's emotional impact), and the "identity" conversation (expressing the situation's underlying personal meaning).

The authors aim to accurately identify key characteristics of personality that are present in all people, through understanding how people are energized, what kind of information they naturally notice and remember, how they make decisions, and how they organize the world around them.  Based on Meyers-Briggs/Keirsey  typing.

These candid accounts of the unstructured world of mediation are thought-provoking, entertaining, alarming, compelling, instructive, and extremely helpful. The quirky characters, the startling facts, and the deeply human decision-making processes in these stories will resonate with every experienced mediator. By inviting readers to sit next to the mediator as these stories unfold, Jeff Krivis has done an enormous service to the field of dispute resolution."

This book provides a detailed overview of mediation, from the pre-mediation conference through all stages of the mediation session. It guides the new mediator through the mediation process by answering the one hundred questions most frequently asked by new mediators.

This books how bioethics mediation differs from both traditional mediation and traditional bioethics consultation; how to apply mediation skills and techniques to health care disputes; how to implement a mediation program in a hospital or other health care setting. Working from the assumption that bioethics disputes are essentially conflicts in need of skilled dispute mediators, this hands-on guide is designed to teach mediation skills in order to clarify and address the underlying issues.

This work makes a strong case for mediation in divorce, civil, and business disputes, emphasizing four benefits of the process: saving money, saving time, retaining control, and maintaining critical relationships. Allen and Mohr, partners in the mediation training firm Coast to Coast Mediation, sprinkle their easy-to-read text with cartoons and quotations generally selected from individuals who have experienced mediation or its grisly alternative.

This book is very practical and should be useful in conflict situations throughout the world. It is based on the collaborative work of the authors in South Africa during the transition from apartheid. The book is intended to build the peacemaking skills of non-professional community leaders and it succeeds admirably in achieving this goal. The authors approach peacemaking from a religious perspective, but the book can be used in both religious and secular settings.

For everyone who works in and with groups-including mediators, managers, committee chairs, team leaders, consultants, teachers, and trainers-Reaching for Higher Ground in Conflict Resolution presents clear principles and proven techniques for productive group experience.

Cassandra's Angel is a powerful tale that shows how stories of shame, fear, rejection, and indifference affect a little girl named Cassandra. Through an encounter with an angel that has accompanied her since before birth, Cassandra realizes that she doesn't have to accept the stories she has been told by her scolding mother, uptight teacher, rejecting peers, or the dismissive mayor. Rather, she could choose to believe that she was a bright light in the world-and that no one could change that story!

Frances Hodgson Burnett's classic children's story was remade for this admirable 1993 release, executive produced by Francis Ford Coppola and directed by acclaimed Polish filmmaker Agnieszka Holland. Splendidly adapted by Edward Scissorhands screenwriter Caroline Thompson.
