General Sessions Civil Mediation Training for Volunteer Mediators

6.75 hrs CLE credit
includes lunch on Saturday

Fees:  $10 for those requesting CLE credit; otherwise, $5.  Checks should be made out to UT College of Law.

Day One  4:00 PM – 7:00 PM (1.75 hr Gen, 1.0 hr Dual)

  • Introduction to Community Mediation
    • Introduction to training objectives; history of CMC; VOMC Act components; state and national context.

 

4:30-5:30 PM (1 hr Gen.)  Jackie Kittrell, Becky Jacobs

  • Comparing & Contrasting Models of Mediation
    • How various styles of mediation used by Rule 31 mediators compare to the CMC Model; co-mediation; analysis of CMC facilitative phase model.

  • Ethics and Community Mediation
    • How to deal with self-represented parties; the attorney advocate’s role in mediation; impasse; confidentiality; avoiding the “practice of law” and legal roles; party empowerment; settlement documentation.

    • Demonstration of General Sessions Civil Mediation, followed by Q&A

11:15-12 Noon (.75 hr Gen.)

  • Participatory Role-Play and Coaching
    • Participants will role-play mediation, observed by experienced CMC mediators, followed by coaching in small groups.

12:15- 1:15 PM (1 hr. Gen)  (Judge Chuck Cerney, Patti Wheeler, Julian Wick, Lon Young, Sam Fowler, Greg O’Connor)

  • Judge and Mediator Panel, Q&A
    • Panel to share experiences, discuss issues, answer questions from participants.

 

1:15-1:30 PM (.25 hr. Gen)

  • Wrap-up
    • Recap training objectives and go over logistics to observe in General Sessions Court (badging, security, location, parking)

 

 

Directions to the law school for those of you who are not familiar with this area of Knoxville:

 

The law school faces Cumberland Avenue on the corner of 15th (aka James Agee Ave).  It is easier to enter from the back (White Avenue) after you park.  Proceed east on Cumberland (toward downtown); turn LEFT onto 16th St and go one block to White Ave. 

On the NW corner of White and 16th is a multi-level parking garage, marked UT Staff and Faculty.  Go in anyway!  Park anywhere marked for staff or faculty. 

Walk out of the garage and walk east on White toward the law school.  You will see the back of the law school on your RIGHT. 

Go up the steps and into the back door (double doors).  We will be in Room 135, on the first floor.  If entering through the back door, you will be on the 2nd floor; just walk down the hall and take the stairs down one flight, then walk back toward the rear of the building. 

If you enter through the front doors, walk straight back on the first level.  We'll try to have signs pointing the way.

CLEs: 
5.75 Hrs General CLE credit and
1.0 Hr Dual CLE credit

CMEs:
5.75 Hrs General Specific Mediation hours and
1 Hr Mediation Ethics Hours.


If a listed Rule 31 general civil mediator attends all the hours, he/she will have fulfilled the all the CME hours needed for renewal. If a Rule 31 listed family mediator takes all the hours, he/she will have fulfilled the 3 hours in mediation issues (as one of those hours is an ethics/dual hour) and will only need an
additional three hours in family law.
